You might not agree with the results of the police report for your DUI case the first time you see it. The report contains the results of the field sobriety test, the preliminary alcohol screening and the breath test.

The results may reveal that you slurred when you talked, your breath reeks of alcohol, and that you may have zigzagged when you walked.

Even though you know some of it may not be true, the police report can be at your advantage. The police officer will stick with the report. If he or she gives an inconsistent testimony, then you or your lawyer can dismiss the testimony and even win the case.

Here are the four tests in a DUI case and their key elements:

  • The Blood Test. This is a difficult test to counter when the results show you failed. If the results are at .08 or more, then there is a very big chance that you will lose. One way to challenge this result is if your lawyer can prove that the blood used in the test is, in fact, not yours.
  • The Breath Test. If this test puts you at .11 and above, then there is a big chance that you will lose the case. However, unlike the blood test, this one is less rigid. There are a lot of factors that affects the results of this test. This means your attorney can claim that the test was not properly handled.
  • Urine Test. The alcohol content seen in the urine is not as accurate as the alcohol content seen in the blood. This makes it the easiest test to contend.
  • Field Sobriety Test. The National Highway Traffic Safety Administration (NHTSA) has strengthened the guidelines for this test, because it used to be easily challenged in the past.
